
The Hague Calls on Armenia and Azerbaijan to Refrain from Provocative Actions
The International Court of Justice (The Hague) issued two orders on December 7 regarding the applications filed by Armenia and Azerbaijan for the court to issue provisional measures against the other concerning alleged violations of the 1965 International Convention on the Elimination of All Forms of Racial Discrimination.
The Court called on both countries to “refrain from any action which might aggravate or extend the dispute before the Court or make it more difficult to resolve.”
In the case Armenia filed against Azerbaijan, the Court called on Baku to:
- Protect from violence and bodily harm all persons captured in relation to the 2020 Conflict who remain in detention and ensure their security and equality before the law.
- Take all necessary measures to prevent the incitement and promotion of racial hatred and discrimination, including by its officials and public institutions, targeted at persons of Armenian national or ethnic origin.
- Take all necessary measures to prevent and punish acts of vandalism and desecration affecting Armenian cultural heritage, including but not limited to churches and other places of worship, monuments, landmarks, cemeteries and artefacts.
The Court did not satisfy Armenia’s demand that Azerbaijan must immediately release all Armenian prisoners of war, hostages and other detainees in its custody who were made captive during the September-November 2020 armed hostilities or their aftermath.
In addition, the Court overlooked Armenia's demand that Azerbaijan close the so-called Trophy Park in Baku. Armenia argued that the exhibit is racist and depicts Armenian soldiers in a highly demeaning fashion.
In the case Azerbaijan filed against Armenia, the Court called on Yerevan to:
- Take all necessary measures to prevent the incitement and promotion of racial hatred, including by organizations and private persons in its territory, targeted at persons of Azerbaijani national or ethnic origin.
